Terms of Sale
Vehicles offered for sale through AMCS are the responsibility of the Owner / Seller. AMCS acts as the Seller’s agent and relies fully on the information provided by the Seller of the vehicle in the advertising and sale of each vehicle. AMCS takes no responsibility for the accuracy or veracity of the information provided by the Seller.
When a Buyer wishes to inspect a vehicle listed for sale on the AMCS web site AMCS issues a tax invoice for 5.5% holding deposit that when paid takes the Seller’s vehicle off the market. This also acts to satisfy security concerns, and places the vehicle on hold awaiting the Buyer’s inspection. The provision of the Buyer’s credit card details is sufficient to achieve this.
Once AMCS has received the Buyer’s deposit/credit card details we put the Buyer in touch with the Seller. The Buyer must make his own enquiries and inspections regarding the condition, authenticity and veracity of the vehicle and any statements made by the Seller, and satisfy themselves in all aspects prior to purchasing the car from the Seller. The Buyer understands there is no warranty or guarantee offered by either the Seller or AMCS.
If on inspection the Buyer is satisfied with the car then the holding deposit becomes part of the sale price. If not satisfied, the deposit is refunded in full and the car is made available again to the market. If credit card details are supplied to meet the deposit they are subsequently deleted from AMCS records .
Once the Buyer is satisfied and a price is agreed to with the Seller a contract is entered into formalised by an AMCS tax invoice of sale. This is sent to the Buyer for payment to AMCS. At this point the Buyer and Seller are committed to the sale of the vehicle and a decision to exit the sale is a breach of the contract and can result in loss of deposit or claim for damages.
Once AMCS receives cleared payment a transfer is then made to the Seller. AMCS arranges a Bill of Sale releasing the vehicle from the Seller to the Buyer and stating the vehicle is free of encumbrance and has no warranty.
AMCS receives a fee of 5.5% (incl.gst) of the sale price for assisting the Seller to sell his vehicle. There is no cost or Buyer’s premium charged to the Buyer.
